Terms of service

Scope

These general terms apply to the services HolaDomus provides to developers. They form part of every accepted proposal, except where the proposal expressly provides otherwise. The provider is HolaDomus (trade name), with the details given in the legal notice.

Who they are for

HolaDomus services are contracted exclusively by businesses and professionals: property developers and their sales managers. They are not contracted with consumers.

Home buyers use the site free of charge and contract nothing with HolaDomus.

Services and scope

Website and pages of the development, multilingual marketing, search engine optimisation, contact acquisition, request dashboard and any other services described in the proposal.

HolaDomus provides its services with the diligence of a digital marketing professional, but does not guarantee a number of sales or contacts, or a return on investment: its obligation is one of means, not of result.

How to contract

Nothing is contracted or paid on this site. After a first conversation, HolaDomus sends a written proposal with the scope, price, schedule and, where applicable, duration. The contract is concluded when the client accepts it in writing, by signature or by email.

The contract is executed in Spanish. If a translation is provided and there are differences, the Spanish version prevails. HolaDomus files the accepted proposal and these terms and sends them to the client.

Price, invoicing and payment

The price is stated in the accepted proposal. Prices include VAT (IVA, standard rate of 21 %), unless the proposal expressly states otherwise.

Depending on the service, the price is fixed per project (website and development pages), monthly (marketing and search optimisation) or a monthly fee plus a fixed price per contact received (contact acquisition), always agreed before starting. HolaDomus never charges a percentage of sales.

The advertising budget is not part of the price: the client pays it directly to the platforms (Google, Meta or others), in accounts opened in its own name.

HolaDomus issues an invoice for each payment. Payment is made in the manner and within the periods stated in the proposal. If a payment is late, HolaDomus may suspend the service after giving written notice and a reasonable period.

Monthly services: renewal and cancellation

Monthly services are invoiced by the month and renew automatically each month, unless the proposal sets a minimum term. The client may cancel them at any time by writing to info@holadomus.com; cancellation takes effect at the end of the current month, or of the agreed minimum term if there is one. The month already started is not refunded.

Client obligations

The client provides in good time the information, materials and access needed, and is responsible for the information about its development (prices, surface areas, specifications, licences, timescales and the information the law requires to be given to buyers) being true and up to date. HolaDomus publishes what the client provides and does not verify the legal or technical status of the development.

Ownership of what is created

The development's domain name and the advertising and analytics accounts are registered in the client's name. The website, texts, photos and videos created for the development, and the contacts received, belong to the client once the corresponding service has been paid, under the access and handover conditions set in the proposal. HolaDomus keeps its general tools, templates and methods, and only cites a piece of work as a reference if the client authorises it.

Personal data of buyers

The buyer contacts that arrive through the client's development belong to the client, who is their data controller. HolaDomus processes them only on the client's behalf and instructions, as a processor, and both parties sign the data processing agreement required by article 28 GDPR together with the proposal.

Liability

HolaDomus's total liability towards the client for any matter related to the service is limited to the amount actually paid by that client in the twelve (12) months preceding the event giving rise to it, and loss of profit and indirect damage are excluded, except in cases of wilful misconduct or gross negligence.

HolaDomus is not liable for decisions of advertising platforms or search engines (ad rejections, algorithm changes, account suspensions) or for failures due to force majeure.

Right of withdrawal

As the services are contracted only between businesses and professionals, there is no right of withdrawal.

Governing law and jurisdiction

These terms and each contract are governed by Spanish law. For any dispute, the parties submit to the courts of Alicante.
